Terms of Service

These Terms and Conditions ("Terms") govern your access to and use of the Aura service available at https://aura4you.io (the "Service"), operated by Nervous Group LLP, a limited liability partnership registered in England and Wales under partnership number OC455606, whose registered office is at 27 Old Gloucester Street, London WC1N 3AX, United Kingdom ("we", "us", "our").

By creating an account or otherwise using the Service you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

The Service contains material intended for adult audiences. You must be at least 18 years of age, or the age of majority in your jurisdiction (whichever is greater). By using the Service you represent and warrant that you meet this requirement and that doing so is lawful in the country from which you access the Service.

2. Nature of the Service

Aura provides interactive conversation, images and audio generated by artificial-intelligence systems. All characters, dialogue and media on the Service are fictional and AI-generated. No real living person is depicted. Any resemblance to a real person is coincidental and unintentional.

Outputs are produced automatically and may be inaccurate, offensive or otherwise unsuitable. The Service is supplied for entertainment purposes only and is not a substitute for professional medical, legal, financial or psychological advice.

3. Account

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must provide accurate registration information and update it if it changes. You must notify us at support@aura4you.io of any unauthorised use of your account.

We may refuse, suspend or terminate any account at our discretion, including where we reasonably suspect a breach of these Terms.

4. Tokens and Purchases

The Service uses an internal virtual currency ("Tokens" or "Energy"). Tokens are a digital good and have no cash value outside the Service.

  • Tokens may be purchased via card payment processed by our payment provider, or via supported cryptocurrencies.
  • The price displayed at the time you initiate a purchase is binding for that transaction.
  • Tokens are non-refundable except where a refund is required by mandatory consumer-protection law.
  • The cost of in-app actions and the contents of Token packs may change at any time without prior notice.

By starting a purchase you expressly request that the digital content is supplied immediately and you acknowledge that you thereby lose the right of cancellation under regulation 37 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, where applicable.

5. Acceptable Use

You must not, and must not attempt to:

  • generate, request, upload, share or otherwise interact with content that depicts minors in any sexual or sexualised context, real persons without their consent, non-consensual scenarios, bestiality, gore, terrorism or any other category prohibited by our Safety Policy;
  • reverse-engineer, scrape, automate or otherwise abuse the Service, the application programming interfaces or the underlying AI models;
  • circumvent rate limits, content filters or other technical protection measures;
  • impersonate any person, misrepresent your affiliation or use the Service for any unlawful purpose.

We may remove content, suspend or terminate accounts and report violations to law-enforcement or to platform-level authorities. Severe or repeated breaches lead to termination without refund of unused Tokens.

6. User Content

If you submit text, images or other material to the Service ("User Content") you grant Nervous Group LLP a worldwide, non-exclusive, royalty-free licence to host, store, copy and process that content for the sole purpose of operating the Service. You retain ownership of your User Content. You represent and warrant that you hold all rights necessary to grant this licence.

7. Intellectual Property

The Service, including its software, look-and-feel, generated characters, generated outputs and trademarks, is owned by or licensed to Nervous Group LLP and is protected by copyright and other intellectual-property laws. You receive a limited, revocable, non-transferable licence to use the Service for personal, non-commercial purposes. No other rights are granted.

8. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that AI outputs will be accurate, appropriate or reliable.

9. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid to us in the twelve months preceding the event giving rise to the claim, or (b) £100. We are not liable for any indirect, incidental, consequential, special or punitive damages, or for loss of profits, revenue, data or goodwill.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or for fraudulent misrepresentation.

10. Termination

You may stop using the Service and delete your account at any time from the Profile page. We may suspend or terminate your access at any time for breach of these Terms or for legal or operational reasons. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) continue to apply.

11. Changes

We may update these Terms from time to time. The "Last updated" date above reflects the most recent change. Material changes will be notified through the Service or by email. Continued use of the Service after a change takes effect constitutes acceptance.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer-protection law grants you the right to bring proceedings in the courts of your country of residence.
